This document is published in accordance with Rule 3(1) of the Information Technology (Intermediaries guidelines) Rules 2011 which mandates the publication of the terms and conditions, privacy policy and rules for accessing or using the mobile application “Shriram Seeds” and the domain name “http://shriramseed.com/” .
User’s use of the Platform is governed by the terms and conditions contained in this document, including the applicable policies (as amended from time to time) which are incorporated herein by way of reference. By mere use of the Platform, User shall be contracting with SHRIRAM SEEDS PRIVATE LIMITED , the owner of the Platform. The Terms of Use, including the policies (as amended from time to time), constitute User’s binding obligations, with Shriram Seeds Pvt Ltd.
The Terms of Use must be read and understood by Users. Before using or continuing to use the Platform, Users must agree to the terms of the Terms of Use. If the User continues to use the Platform, it is assumed that they have accepted these Terms of Use.
The Platform is owned and operated by SHRIRAM SEEDS PRIVATE LIMITED, having its head office at , 38-39 Jawahar Market (Old Grain Market), SRI GANGANAGAR 335001, Rajasthan, India.
Whether a Buyer-User or a Seller-User utilizes any of the Services offered by SHRIRAM SEEDS PRIVATE LIMITED through the Platform, they shall be bound by the regulations, guidelines, policies, terms and conditions associated with those specific Services. Transactions involving the sale/purchase or provision of Products and other activities on the Platform will adhere to the governmental regulations, guidelines, policies, and terms and conditions governing such transactions. In case of any inconsistency between these Terms of Use and the aforementioned government regulations, guidelines, policies, or terms and conditions, the latter will take precedence.
SHRIRAM SEEDS PRIVATE LIMITED reserves the right, at its sole discretion, to change, modify, add, or remove portions of these Terms of Use, at any time without any prior written notice to User. Users shall ensure to review these Terms of Use periodically for updates/changes. User’s continued use of the Platform after the posting of changes will mean that User accepts and agrees to the revisions. As long as User comply with these Terms of Use, Shriram Seeds Pvt Ltd grants User a personal, non-exclusive, non-transferable, limited privilege to enter and use the Platform.
By either implicitly or explicitly agreeing to these Terms of Use, the User also acknowledges and consents to adhere to the policies of SHRIRAM SEEDS PRIVATE LIMITED. These encompass, though are not restricted to, the Privacy Policy that may be periodically revised and is accessible on the Platform.
- Definitions
For the purpose of these Terms of Use, wherever the context so requires, “Affiliate” shall mean, with respect to each party, any person or entity directly or indirectly through one or more intermediary Controlling, Controlled by, or under direct or indirect common Control with a party. “Control”, “Controlled” or “Controlling” shall mean, with respect to any person or entity, any circumstance in which such person or entity is controlled by another person or entity by virtue of the latter person or entity controlling the composition of the board of directors or managers or owning the largest or controlling percentage of the voting securities of such person/entity or otherwise controlling the other. “SHRIRAM SEEDS PRIVATE LIMITED ” shall mean and include Shriram Seeds Pvt Ltd. and all its Affiliates. “User” shall include any person or entity who uses our Platform for transacting/trading/surfing/gathering information relating to the products and services listed on the Platform. The expression “Users” includes, without limitation, sellers who list their products on the Platform (“Seller-User”), buyers, including the retailers, who buy Products listed on the Platform (“Buyer-User”), etc.
- Membership Eligibility
- Use of the Platform is available only to persons who can perform legally binding contracts under the Indian Contract Act, 1872. Persons who are “incompetent to contract” within the meaning of the Indian Contract Act, 1872 including minors, un-discharged insolvent, etc, are not eligible to use the Platform.
- If User is a minor, under the age of eighteen (18) years, User shall not register as a member of the Platform and shall not sell, purchase or bid for any items on the Platform except through User’s legal guardian or parents who have registered as Users on the Platform. SHRIRAM SEEDS PRIVATE LIMITED reserves the right to terminate User’s membership and refuse to provide User with access to the Platform if it is brought to notice of Shriram Seeds Pvt Ltd. or if it is discovered that User is under the age of 18 years.
User Account
- If User uses the Platform, User shall be responsible for maintaining the confidentiality of its account and password and for restricting access to its computer or other devices to prevent unauthorized access to its account.
- User agrees to accept responsibility for all activities that occur under User’s account or password, and User agrees, inter alia, to:
- Provide true, accurate, current, and complete information about User as prompted by SHRIRAM SEEDS PRIVATE LIMITED’s registration form (such information being the “Registration Data”).
- Include any of User’s contact details such as mobile number, email address, in User ID while registering as a User.
- Maintain and promptly update the Registration Data to keep it true, accurate, current and complete at all times.
- Immediately notify SHRIRAM SEEDS PRIVATE LIMITED of any unauthorized use of User’s password or account or any other breach of security and Ensure that User exits or logs out from its account at the end of each session.
- User agrees that if User provides any information that is untrue, inaccurate, not current or incomplete or SHRIRAM SEEDS PRIVATE LIMITED has reasonable grounds to suspect that such information is untrue, inaccurate, not current or incomplete, or not in accordance with the Terms of Use, Shriram Seeds Pvt Ltd shall have the right to indefinitely suspend or terminate or block access of User’s membership on the Platform and refuse to provide User with access to the Platform.
- User can access and update the information, User provided SHRIRRAM SEEDS PRIVATE LIMITED with, in the account area of User of the Platform.
SHRIRAM SEEDS PRIVATE LIMITED reserves the right to refuse access to the Platform, terminate accounts, remove, or edit content at any time without notice to the User.
